Manhattan DA says it is ‘absolutely’ considering plotting charges against bodega workers

The Manhattan District Attorney announced Tuesday that he is “absolutely” considering dismissing the charges against a bodega worker who stabbed an ex-convicted stump out of apparent self-defense.

Jose Alba, 61, was arrested on July 1 after fatally stabbing Austin Simon in the neck and chest.

But surveillance footage clearly showed Simon, 37, moving behind the desk in the Blue Moon store and stabbing him in a pile of planks before grabbing the older man.

It was only then that Alba came to a plank and pulled out a knife to fight back.

He was then allegedly stunned by Simon’s girlfriend, who is not justified.

In the weeks since, residents of the Big Apple – including even Mayor Eric Adams – have condemned Alba’s arrest and called for his release.

And on Tuesday, the New York Post reports, District Attorney Alvin Bragg told a group of bodega owners that there was ‘absolutely’ a chance he could drop Alba’s murder charges.

Alba had a cut on his arm, which resulted in Simon's girlfriend attacking him first, his family says

Screenshots from the Blue Moon convenience store showed that Jose Alba, 61, was attacked before grabbing a knife and Austin Simon, 37, began stabbing on July 1st.

“We felt very good because his tone was very reassuring,” United States Bodegas spokesman Fernando Mateo said of the closed-door group meeting with Bragg at his office.

“His attitude was very direct, and he said, ‘I do not understand why people jump to conclusions. I have not made a decision. I am investigating.’

‘I asked,’ Are the chances of you dropping the charges? ‘ And he said, “Absolutely,” Mateo said.

However, Mateo said Bragg left room to continue printing the case.

“He explained to us the whole routine of what happens when a crime or an alleged crime is committed and what happens next,” Mateo said, adding: “We are very hopeful that Jose Alba’s case will be dismissed. are left by the arrondissement.

‘He has not made that provision yet, but he did leave the doors and windows open to make that happen.

“Therefore, we must sit and wait, not become impatient and not jump to conclusions.”

The pressure had grown for Bragg to drop the charges against Alba, since images appeared showing that Simon – who had previously been convicted of assault – had shoved Alba into a plank and started dragging him.

The images show the two wrestling it before Alba grabbed his knife and started stabbing.

Other videos obtained by DailyMail.com show Simon – who was on parole for attacking a police officer when he died – marching behind the bodega counter to confront Alba.

“Dad, I do not want a problem, Dad,” Alba told him calmly.

Simon stepped into the Blue Moon convenience store minutes after his girlfriend tried to buy a bag of chips for her daughter, but her preference card was denied.

The woman, who claimed that Alba had taken the bag with chips from the child, is heard on the video asking Alba, ‘Did you set food?’

Alba responds that he will try her card another time.

‘Okay, Mom, let me do it another time. My God, ‘he says to her as she insists,’ there is money on it. ‘

But he scans the card multiple times and hands it back to her and tells her it is not working.

The edited footage cuts to show other customers in the bodega when the woman is called out of the camera.

‘You can not touch my daughter. Do not seize my daughter, you f-king piece of shit! ‘

The woman had reported that Alba took the bag of chips out of her daughter’s hands when they could not pay.

She goes on: ‘I’ll bring my n– down here and he’s going to pick you up. My n— will come down here now and f – k you up! ‘

Alba tells her that it is not his fault and that the card did not work.

Another woman asked, ‘Did they take anything from you?’ Alba replied, ‘No, I’m taking it back.’

Simon is then seen in the video storming the store and walking behind the counter where he is confronting Alba.

‘What’s wrong with you? N **** r what’s wrong with you? ‘ he calls to him.

It is then that Simon Alba pushes into the board.

The new video footage, it cuts to see bloody Simon splayed out on the bodega floor. His girlfriend is heard shouting, ‘That was more than $ 3. Three f ** king dollars. He’s got my daughter something … please help him. ‘

The man's family set up a GoFundMe to help him pay for his legal defense, but it was removed overnight after raising $ 20,000.

After the dispute, Simon was taken to a local hospital where he was pronounced dead while Alba was thrown into the infamous Riker’s Island prison on a charge of murder.

He was originally detained on a $ 250,000 bail, but the Attorney General’s Office lowered it last week to $ 50,000 amid growing scandal.

Among those who expressed their support for Alba was New York City Mayor Eric Adams, who even visited the Harlem bodega to offer his support.

‘I am a person who is there for people who follow the law. “I watched the video, I saw a voter here in the store following the law … It’s time for New Yorkers and Americans to start standing up for people who follow the law,” he said. is.

Republican gubernatorial candidate Lee Zeldin also echoed Bragg’s decision to sue Alba, tweeting: ‘My first day 1 action as governor next January will be to fire Manhattan DA Alvin Bragg.’
