Opposition

The TM7A application only extends the period of opposition to three months from the date of publication of the mark under consideration for opposition.

This means that in some cases, despite submitting TM7A, TM7 will also expire on the first day without interruption. For applications published before April 24, 2020, TM7A will not be effective and you will need to submit Form TM7.

For more specific guidance, check the issue date for TM7A impacts (these take into account weekends and bank holidays):

Defense (Form TM8)

The TM8 deadline cannot be extended (must be submitted by July 30 unless the parties enter the cooling-off period and mutually agree to submit Form TM9c). It is highly recommended that the party meet the existing deadline.

Deadline and extended time

We are currently working on a regular deadline. The parties currently involved in the refereeing process must follow the advised schedule. Further communications will be issued when they reach the next round of evidence.

Extensions of time must be submitted in the usual way (Form TM9 and accompanying reasons). Appeals to the nominated person can be considered and appeals to the court must be filed directly with the court.

Hearing service

Access to our site is restricted, but direct hearings are not possible. This is under review. For the time being, we will continue to hear by phone, Skype, and other virtual methods.

If we needed to change the current hearing arrangements, we contacted the parties. Some hearings, such as cross-examinations, may not be suitable for phone calls, Skype, or other virtual methods and may need to be postponed.

Company name court

When inquiring about the services of Company Names Tribunal, please contact us. forms@ipo.gov.uk Email address to submit all forms. There is no online process.Please use cna@ipo.gov.uk Email address for submitting all communications and all evidence. This will ensure that an electronic record of your submission is created and processed as soon as possible.

Please note that the court is at the Intellectual Property Office and the site is currently closed. The referee is currently in operation, but the parties should expect some delay. The form is processed once the referee has access to the normal office process.

We can accept digital signatures for forms and other documents. It will be extended when a new deadline is set. For example, filing a defense, filing evidence, changing the company name, or appealing the arbitrator’s decision. Deadline settings will be reviewed over the next few weeks.
